Dan McLawhorn has provided some excellent legal research and his analysis of some of the questions that might arise in a contest between riparian rights to withdraw water and public trust rights. Here is his manuscript. The answers are by no means clear under North Carolina law, which is itself an argument for legislation in this area in North Carolina.
